Leaves of Absence

This section briefly summarizes leaves of absence for the Lynwood USD classified service. All leaves of absence are subject to the provisions of the Personnel Commission Rules and Regulations. Paid Sick Leave
Sick leave is the authorized absence of an employee, due to illness or injury. Sick leave may be taken at any time. Employees with probationary status may only use up to six days of paid sick leave during their initial probationary period. An employee’s pay for any day of paid sick leave shall be the amount of money that the employee would have earned if he/she had worked on that day. An employee, who is otherwise eligible for district-paid fringe benefits, shall continue to receive such benefits during all periods of paid sick leave or other paid leave(s).

Medical Leave of Absence
To be used when an employee is unable to perform duties as the result of a medical condition. Medical leave will be charged in the following order to an employee’s leave bank: (1) sick, (2) vacation, (3) floating holiday. A doctor’s statement must be received by a supervisor and forwarded to Classified Personnel before a leave of this nature can be granted/approved.

Leave(s) of Absence Without Pay
Leave of absence without pay may be granted to a permanent classified employee upon the written request of such employee and the approval of the Superintendent of Schools or his/her designated representative. If, at the conclusion of all sick leave and additional leaves (paid or unpaid) granted by the District, the employee is still unable to assume the duties and responsibilities of his/her position, the employee shall be placed on a reemployment list for a period of 39 months. 

Personal Necessity Leave
An employee may claim and deduct up to seven days per year from their accumulated sick leave for reasons of personal necessity. When an employee wants to claim personal necessity, the employee needs to outline the nature of the personal necessity. Personal necessity leave time will not be granted during an employee’s scheduled vacation or other leave of absence.

Industrial Accident and Industrial Illness Leave
A classified employee who is absent from duty because of an illness or injury determined to be an industrial accident or an industrial illness can be granted as paid industrial accident illness leave; provided that the employee has probationary or permanent employment status with the District. Such paid industrial accident/illness leave shall not exceed sixty workdays. If the employee is still unable to return to duty after exhausting the sixty days of industrial accident/illness leave, the employee may use alternate paid leave. If the employee is still not able to return to work, the employee can be granted leave without pay. The total time of all leave benefits shall not exceed 36 months for any one industrial accident or industrial illness. When an employee has exhausted all rights paid and unpaid leaves of absence following an industrial accident or industrial illness, and the employee is still unable to resume his/her employment with the District, the employee will be placed on the 39 month reemployment list.

Bereavement Leave
Bereavement leave is not to exceed three days, when local; or, five days, if traveling beyond 350 miles is required, due to the death of any member of the employee’s immediate family.

Jury Duty and Witness Leave
Leave(s) of absence for jury service shall be granted to any classified employee who has been officially summoned to jury duty in local, state, or federal court (excluding Grand Jury Service). Leave time shall be granted for the entire period of jury service. Any request for jury service leave should be made by presenting the official court summons to jury service to his/her immediate supervisor as soon as possible after it has been received. An employee who has received a leave of absence under this rule shall make himself/herself available for work during such periods of time when his/her presence is not required in court, by advising his/her supervisor on a daily basis of his/her jury service schedule.

Military Leave
Regular classified employees under official orders who are called to active duty in the Armed Forces of the United States of America, including the Coast Guard, shall be granted military leave of absence. 

Absence for Examinations
Every classified employee shall be permitted to be absent from his/her duties (or position) during working hours in order to take any examination, within the District without deduction in pay or other penalty; provided that he/she gives at least two (2) days’ notice of such absence to his/her immediate supervisor. Absence or release time granted under the provisions of this rule shall be limited to the duration of the examination plus any necessary travel time to and from the examination site.

Pregnancy or Maternity Leave
If it is determined that an employee is no longer capable of performing the duties of her position due to pregnancy, or pregnancy complications, the employee shall be placed on a leave of absence. The employee shall be allowed to utilize her cumulative sick leave; or, if the period of disability continues beyond the amount of available sick leave time, additional paid leave may be used as provided for in Personnel Commission Rules and Regulations. The employee is required to submit the necessary doctor’s reports and clearances to the Classified Personnel Office to continue using leave time. The employee may return to duty postpartum by submitting a doctor’s statement, which indicates that the employee is in good health and can resume the duties and responsibilities of her position. An employee who is absent from duty because of a pregnancy disability will be expected to return to duty within 30 days following completion of the pregnancy. Should the employee be unable to return to duty because of a continuing health problem, she shall file a doctor’s statement with the Classified Personnel Office that indicates her prognosis and the expected return date. In the event that the disability resulting from the employee’s pregnancy exceeds a period of five months from the original date of the disability, the employee shall be placed on a 39 month reemployment list; unless:

  • A leave of absence without pay is granted to an employee for a period of six months

  • The employee requests and is granted an unpaid leave of absence for a period of time not to exceed one (1) year for purposes of child-rearing.

Time Off To Vote
Members of the classified service who are registered to vote shall be allowed time off at the beginning or the end of the workday (without loss of pay or other penalty) that will allow them the opportunity to vote. However, such time off shall not exceed two hours.
